Mintz Member Michael Graif was quoted in Managing IP discussing the new edict from the Court of Appeals for the Federal Circuit, which could make it harder to prove that rights holders have abandoned their marks. Michael commented, "This conclusion is notable because it reenforces the idea that 'use is king' in the US, unlike in most countries where registration determines priority".
