Keeping Tabs On Fight Over Board Diversity Rule At 5th Circ.
ESG Co-chair Jen Rubin, and Associates Danielle Dillon and Evan Piercey co-authored an article in Law360 on the US Court of Appeals for the Fifth Circuit's rejection of a challenge to Nasdaq's diversity rule.
The authors wrote, "On Oct. 18, the U.S. Court of Appeals for the Fifth Circuit rejected the challenge to a Nasdaq Stock Market diversity rule, which requires exchange-listed companies to publicly disclose the makeup of their boards.'
'In its decision in Alliance for Fair Board Recruitment and National Center for Public Policy Research v. SEC, the court rejected two conservative groups' challenges to the U.S. Securities and Exchange Commission's authority to approve the rule.
"The petitioners have filed a motion for en banc review."
