  • Advising clients on their industry information-sharing programs in light of DOJ and FTC concerns regarding the use of AI algorithms to foster collusion.
  • Advising on developing strategies and assessing pathways for obtaining FDA marketing authorization for software as a medical device with artificial intelligence / machine learning (AI / ML) functions.
  • Advising software developers on limiting certain AI / ML functions or claims relating to such functions to avoid classification as a medical device.
  • Advising clients on patent strategies when applying artificial intelligence to the discovery and development of therapeutics and to enhance diagnostics systems and patient care.
  • Advising clients in connection with the commercialization of their technology platforms and eventual sale.
  • Advising clients on the acquisition of AI platforms, due diligence support, and other transactional matters in the space.
  • Advising software and technology services companies in digital transformation projects, Canadian patent prosecution, licensing and distribution agreements, and negotiation of contracts with customers.
