The Situation
Our client, an automotive supplier portfolio company of our private equity firm client, sued a large truck manufacturing company that had, in violation of the parties’ contract, taken actions causing the automotive supplier to lose time on its assembly line. It failed to compensate our client for this lost time in accordance with the contract.
The Approach
Mintz assembled a team of litigators to tackle the complex issues and obstacles in this manufacturing dispute. Adding to the complexity of the case was the fact almost all of our witnesses had left the company, and one of our key witnesses was not a native English speaker.
The Outcome
Following an 8-day arbitration, a 3-member arbitration panel awarded our client over $10 million, including attorneys’ fees. All counterclaims against our client were denied.
