Mintz represents an American thoroughbred horse racing facility with respect to its racing, poker, golf, and dining exposures. We provide insurance and risk management solutions for their unique and complex exposures.
The Approach
Our representation includes identifying and analyzing the client’s loss exposures, evaluating potential risk management techniques, and, where appropriate, utilizing insurance and indemnification agreements as risk management techniques. In so doing, we negotiate all aspects of their insurance program, including property coverage, flood and wind coverage, general liability coverage, cyber insurance coverage, jockey liability coverage, liquor liability coverage, crime coverage, and directors and officers coverage. For those exposures where indemnification is a more appropriate risk management strategy, we draft and negotiate indemnification agreements to transfer the client’s risk. We also assisted the racing facility with respect to the insurance and regulatory implications of its acquisition of another racing facility.
