School of Hard Knocks: Distressed Higher Ed

For some time experts have been predicting an increase in defaults by higher education institutions. As some of those predictions become reality we will explore some of the reasons for the increase in distress and lessons learned from recent experiences. This panel will review the general landscape of education credits including at-risk and success indicators and trends in security features and covenant structures. We will address issues specific to women’s colleges and historically black colleges and universities and will discuss recent case studies of defaulted deals.

Miyoko Sato is the Chair of the Mintz Bankruptcy, Health Law, Public Finance, Real Estate, and TechComm Division who represents mutual fund companies, investment advisory firms, insurance companies, and other institutional investors in connection with their investments in tax-exempt securities. She focuses on high-yield, tax-exempt securities.
