Challenging No-Injury Class Actions In State Court
Joshua Briones, Managing Member in Mintz’s Los Angeles office and Crystal Lopez, a Litigation Associate, authored a Law360 column on the worry businesses nationwide are experiencing over facing “no-injury” class action lawsuits. These lawsuits are being filed by individuals seeking “sue deep pocketed companies” who were not actually injured by the product in question. The article notes that though such suits have successfully gone to state courts after failing to proceed in federal courts, they are unlikely to establish standing anywhere, even in the more-liberal state courts.
