Enforcing Patents Isn't Easier As America Invents Act Turns 10
Mintz Member and Intellectual Property Chair Michael T. Renaud, Member Jonathan J. Engler and Associate Jessica Perry co-authored an article published by Law360 reviewing the America Invents Act. The authors summarized, "A review of patent litigation outcomes in U.S. district court cases filed since the AIA went into effect, however, shows that it has not become simpler and easier to enforce valid patents.... Instead, Lex Machina data shows that out of 179 patent jury awards in cases filed after 2012, only 32 high-technology awards exceeded $30 million."
