Environmental Law Practice Chair Jeff Porter discussed the most recent attempt by EPA and the Army Corps of Engineers to say what is a Water of the United States covered by the Clean Water Act with The National Law Journal. Jeff said, "This is going to result in the narrowest Clean Water Act jurisdiction in at least 30 years." He continued, "EPA did everything that the Supreme Court decision requires them to do, but they also maintained language that might be beyond what the Supreme Court allowed."
