EPA Requires Industrial Sites to Plan for Pollution from Floods
Environmental Law Chair Jeff Porter spoke to Bloomberg Law about the EPA’s new proposed Safe Communities by Chemical Accident Prevention Rule, requiring industrial sites to prepare response plans for pollution from floods. Jeff specifically commented on the rule’s legal vulnerability, mentioning that the EPA has not sufficiently explained why a location within a half-mile of navigable water or a conveyance to those waters is functionally equivalent to a discharge directly into a larger body of water.
Jeff said, “I don’t understand why the EPA doesn’t even mention Maui. I think at least six justices of the Supreme Court would have a problem with this rule.”
