Environmental Law Chair Jeff Porter spoke to ENR about lessons learned from the Osage Nation’s litigation victory against Enel Green Power North America over Enel’s failure to secure all of the property rights necessary to construct its wind energy project on Osage Nation land.

Jeff said “[companies need to] assess the risk that you are [not] going to get [all of the necessary] approvals upfront because it can go to the viability of the projects.”
