Formal Publication Of CERCLA PFAS Rule Opens Door To Legal Challenges

Environmental Law Chair Jeff Porter spoke with Inside EPA on the recently published CERCLA PFAS rule and its legal implications. The new rule adds two PFAS to the EPA’s list of hazardous substances under the Superfund law, although parties still have nearly 90 days to file legal challenges against the controversial rule.

Jeff said, “[The] rule has implications for everyone from water suppliers to landfills to fire departments and I expect there will be challenges, including to the basis for EPA’s ‘substantial danger’ determination.”
