Lawsuit Alleges Feds Prevented Part-Time RCMP Officers from Buying Back into Pension Plan
Toronto Office Managing Partner Mitch Frazer was quoted in Benefits Canada about a class-action lawsuit filed by the National Police Federation (NPF) against the Canadian federal government. The suit alleges that part-time RCMP officers, who are primarily women, were unfairly prevented from buying back into their pension plans, perpetuating gender discrimination.
Mitch believes the NPF has a strong case with parallels to Fraser v. Canada, stating: “This is essentially Fraser 2.0 as it involves a program that primarily disadvantages women, so I don’t see it going any other way so far as the courts are concerned. Fraser is the law, and nothing has happened in the last four years to give the Supreme Court any reason to overturn their earlier decision.”
