Mintz Members Alec Zadek and Andrew Bernstein Secure Significant Victory for Sandy Alexander in Bet-The-Company Litigation
Mintz Members Attain Multi-Million Dollar Judgement for Premier Marketing Communications Company
Mintz Members Alec Zadek and Andrew Bernstein achieved a significant victory for longtime firm client Sandy Alexander, Inc. in a bet-the-company lawsuit brought against a manufacturer that had breached its contract with Sandy Alexander to deliver a state-of-the-art sheet-fed printing press.
The lawsuit was filed by Mintz in April 2019 in the U.S. District Court for the Northern District of Illinois on behalf of Sandy Alexander, seeking a remedy for an alleged breach of contract. Alec successfully led the Mintz team through early, aggressive discovery, eliciting key testimony during depositions of the opposing party’s employees. Notwithstanding hurdles posed by COVID-19, the Mintz team was able to prosecute Sandy Alexander’s claims efficiently and effectively, resulting in a Judgement awarding Sandy Alexander approximately $3.5 million.
“From the beginning, Alec's and Andrew’s professionalism and dedication were evident. The future of our company depended on the outcome of this dispute. Any dispute is unpleasant but having the Mintz team on our side brought us great comfort. Getting this resolved confirmed we made the right choice,” said Michael Graff, Chief Executive Officer of Sandy Alexander.
“This was a team effort. From Sandy Alexander’s most junior pressman to its Chief Executive Officer and Chairman, the high integrity, candor, and character of its employees and executives are consistent, which was evident throughout the litigation and instrumental to our success. We, at Mintz, are grateful for the opportunity to represent Sandy Alexander in this mission-critical litigation and are proud to have helped secure an amazing result,” said Alec Zadek.
Mintz Associate Leigh Colihan also contributed substantially to the team’s efforts.
The case is Sandy Alexander, Inc. v. Manroland Inc., No. 19 CV 2461, in the U.S. District Court for the Northern District of Illinois, Eastern Division.
