Attorneys from Mintz, Cohn, Ferris, Glovsky and Popeo, P.C. have saved sixty-three of sixty-five challenged patent claims across eight patents in a series of sweeping Inter Partes Review victories for their client, Elm 3DS Innovations, LLC, victories that may pave the way to Elm prevailing in other pending invalidity challenges. 

Petitioners Samsung Electronics Co., Ltd., Micron Technology, Inc., and SK Hynix, Inc. had filed nine IPRs challenging the validity of eight Elm patents concerning three-dimensional integrated circuits.  The U.S. Patent Trial and Appeal Board (PTAB) ruled in those IPRs that the petitioners failed to prove the unpatentability of all but two of the sixty-five challenged Elm 3DS’ patent claims.  The PTAB also will soon decide five similar IPRs filed by the Petitioners against Elm’s patents, for a total of fourteen IPRs against twelve patents. 

Several district court cases have been stayed pending the outcome of the IPRs, and Elm 3DS is looking forward to having its day in court. “This is a significant win for our client and further reinforces the value and quality of Elm’s patents. These victories also bode well for Elm prevailing in the remaining IPRs pending against its patents,” said William A. Meunier, a Member of the Intellectual Property Section.
