Mintz Secures Summary Judgment for Client Horizon Tower
A team of Mintz attorneys won a motion for summary judgment for client Horizon Tower in its case against Park County, Wyoming.
In February 2023, the Park County Commissioners denied a request for Horizon to build a new cell tower in the Wapiti Valley area at the eastern entrance of Yellowstone Park. The consequential lawsuit brought by Horizon claims the County violated the Federal Communications Act in denying a permit to build the tower.
In its recent order, the US District court ruled in Horizon Tower’s favor on all claims and required the County to issue the permit for the tower within seven days.
