Mintz Secures Sweeping Win for Elm 3DS Innovations at U.S. Patent Trial and Appeal Board
A team of Mintz attorneys has successfully defended 105 of 107 patent claims across 14 instituted Inter Partes Reviews (IPRs) in a series of decisive wins for client Elm 3DS Innovations, LLC.
Petitioners Samsung Electronics Co., Ltd., Micron Technology, Inc., and SK Hynix, Inc. filed the IPRs against 12 patents concerning Elm 3DS’ three-dimensional integrated circuits. Earlier this year, the U.S. Patent Trial and Appeal Board (PTAB) ruled in the first nine IPRs that the petitioners failed to prove the unpatentability of all but two of the 65 challenged Elm 3DS’ patent claims. This summer, the PTAB decided the five remaining IPRs finding in favor of Elm 3DS upholding all 42 remaining claims.
Elm 3DS was represented by Michael T. Renaud, the Division Head for Mintz’s Intellectual Property practice, and Intellectual Property Members William A. Meunier and Michael C. Newman.
The Mintz Intellectual Property practice represents petitioners and patent owners in IPRs and prevails on behalf of patent owner clients in 92 percent of the IPRs handled. The team has preserved validity of claims in 89 percent of patent owner IPRs which have been instituted while the industry average is 35% (USPTO IPR statistics as of July 2017).
