Special Counsel Evan Diamond was quoted by Law360 regarding the Federal Circuit’s recent decision on the sufficiency of induced infringement allegations pleaded against a “skinny labeled” generic:

"[The Federal Circuit] is deliberately not giving much specific guidance here about how courts should approach other sets of facts. This is really giving us one data point on the side of plausibility rather than reviewing where the entire line is. We will have to watch for future cases and future data points to see if they start to reveal something clearer about the line."
