Suppliers Out in Patent License Talks After Appeals Ruling
Member Daniel Weinger was quoted in an article published by Bloomberg Law on Continental Automotive Systems Inc.’s recent appeals court loss. The U.S. Court of Appeals for the Fifth Circuit determined that an automotive parts supplier did not have constitutional standing to pursue an antitrust lawsuit against standard essential patent (SEP) owners that refused to directly license SEPs to the supplier on fair, reasonable and nondiscriminatory (FRAND) terms.
