TCPA Regulatory Update — Commission Issues TRACED ACT Report to Congress

Pursuant to Sections 3, 11, and 13 of the Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (“TRACED Act”) the Federal Communications Commission’s Enforcement, Consumer and Governmental Affairs and Wireless Telecommunications Bureau issued its TRACED Act Annual Report to Congress on December 28, 2021. The report detailed a myriad of TRACED Act data, including TCPA complaints received by the Commission and the Commission’s TCPA related actions, such as the number of citations, notices of apparent liability, and forfeiture orders issued; the forfeiture penalties and fines collected; and the regulatory proposals and actions taken to reduce the number of unlawful calls. The data in the report covers various time periods, with some as long as five years (2016 – 2020). The report also provided information and data about the privately led USTelecom Industry Traceback Group’s efforts under Section 13(a) of the TRACED Act.

Attached to the report were several traceback related documents containing: (1) a spreadsheet listing providers and details regarding their participation in traceback efforts; (2) a letter from the Industry Traceback Group describing the privately led traceback efforts; (3) a copy of the Industry Traceback Group’s policies and procedures; and (4) a copy of the Industry Traceback Group’s application to the Commission.
