Monthly TCPA Digest — November 2020

We are pleased to present our latest Monthly TCPA Digest, providing insights and news related to the Telephone Consumer Protection Act (TCPA). In this month’s Litigation Update, we report on the Eleventh Circuit’s potentially game-changing decision in a TCPA class action, Johnson v. NPAS Sols., LLC, in which the court invalidated the use of incentive awards for named plaintiffs. If other courts follow suit, the Eleventh Circuit’s ruling could help to stifle the filing of TCPA lawsuits nationwide.

In our Regulatory Update, we cover FCC developments, including the release of a Public Notice containing instructions on filing for voluntary STIR/SHAKEN implementation exemptions. The TRACED Act creates two “early implementer” exemptions: one for calls over IP networks and one for calls over non-IP portions of networks. Our article outlines how voice service providers can file for these exemptions.
