Laura is an internationally recognized trademark practitioner whose practice encompasses trademark prosecution, brand enforcement and protection, and IP licensing. She represents start-ups to Fortune 500 companies across a wide variety of industries, including financial services, technology, video games, entertainment, and consumer products.

A trusted advisor who leverages her extensive knowledge of global brand protection and in-house experience with a video game developer, Laura provides guidance on all aspects of trademark portfolio development and management. Clients also seek her counsel on intellectual property matters related to financing, mergers and acquisitions, joint ventures, and other strategic transactions.

Laura is also an accomplished litigator who leads trademark litigation before state and federal courts and the Trademark Trial and Appeal Board. She regularly tries high-stakes cases and negotiates successful settlements. Laura has also worked on copyright, patent, unfair competition, false advertising, and domain name cases.

In addition to her practice, Laura also regularly speaks and writes about trademark and copyright issues, including presenting Practicing Law Institute educational programs.

Prior to joining Mintz, Laura was a partner at an international law firm, where she helped manage the trademark professionals and brand protection teams and co-chaired the firm’s Latino lawyers group. Earlier, she was also a partner at a national law firm. 

In law school, Laura served as a member of the La Raza Law Journal.

Experience

  • Advised an American multinational hedge fund and financial services company on a broad range of IP issues, including trademark opposition and cancellation proceedings, UDRP and related domain name proceedings, global trademark portfolio management, global enforcement matters, domain registry matters, and IP licensing.

  • Manages the global trademark portfolio for Little League Baseball, Inc.

  • Managed the global trademark portfolio and oversaw brand enforcement for a leading US fruit producer. 

  • Represented supplements and superfoods company Kiva Health Foods LLC in a trademark infringement litigation against Kiva Brands Inc., a dispenser of cannabis-infused edibles. The case presented a number of novel trademark issues relating to Kiva Brands’ attempted enforcement of its trademark rights for products that are illegal under federal law. Following an evidentiary hearing with witness testimony, Kiva Health defeated Kiva Brands’ laches defense. The case settled favorably for the client.

  • Represented a national real estate and development firm on matters involving intellectual property licenses for master-planned community developments.

  • Defended Chinese generics company Respirent Pharmaceuticals Co., Ltd. in a trade dress infringement litigation brought by Glaxo Group Limited. The case settled favorably for the client.

  • Represented an automotive parts manufacturer in the acquisition of a brake-products brand.

  • Advised Treehouse Foods in the acquisition of Riviana Foods Inc.’s US-branded pasta portfolio.

  • Advised Founder SPAC in connection with its merger with Rubicon Technologies, LLC.

  • Advised Waterstreet Healthcare Partners in its acquisition of Take Care Health Systems, LLC.

  • Represented a leading provider of fitness and wellness programs in the negotiation of an endorsement deal with a well-known athlete.

  • Advised Estrella Immunopharma, Inc., formerly known as TradeUP Acquisition Corp. (NASDAQ: UPTD), on matters related to its business combination with Estrella Biopharma, Inc., a preclinical-stage biopharmaceutical company developing T-cell therapies to treat patients with blood cancers and solid tumors. The combined company operates under the name Estrella Immunopharma, Inc.

  • Advised Texas-based private equity firm The Sterling Group in its formation of Compost360, a platform focused on building an organic waste material processor and producer of sustainable landscaping products, and the acquisition of Nature’s Choice, a New Jersey-based organic waste recycling company and producer of compost, mulch, and engineered soils.

  • Advised KeHE Distributors, an Illinois-based distributor of fresh, natural, organic, and specialty products in North America, in the acquisition of DPI Specialty Foods, a California-based company focused on procurement and wholesale distribution of specialty food products. 

  • Advised Chart Industries, Inc. (NYSE: GTLS), a global manufacturer of highly engineered equipment servicing applications in the energy and industrial gas markets

    • in its $80 million cash acquisition (subject to certain customary adjustments) of L.A. Turbine, a turbomachinery engineering, manufacturing & service company offering a variety of application-specific equipment.

    • in its acquisition of Sustainable Energy Solutions, Inc., an energy solutions company focused on developing and commercializing Cryogenic Carbon Capture™, a patented carbon capture technology that eliminates most emissions from fossil fuels.

  • Advised California-based winery Delicato Family Wines in its announced partnership with Francis Ford Coppola Winery, a longtime leader in the wine industry. Under the terms of the deal, the Francis Ford Coppola wine portfolio and two facilities anchored in Sonoma County, California, will join Delicato.

This case is a victory for public figures and their control over their personal branding. Applicants for trademark registration must continue to get clearance before incurring the significant cost of registration when using a living person’s name. While this decision is likely to have minimal impact on most trademark filings, it does come as part of a larger trend of the Court’s willingness to address longstanding provisions of the Lanham Act. And should Justice Barrett’s prophesy come to pass, this may not be the last word on content-based, view-point neutral restrictions.
