Practice Overview

In the Appellate Practice Group, our capabilities include appeals at both the state and federal levels, as well as amicus curiae submissions to the United States Supreme Court. We continuously collaborate across practice areas, including securities and shareholder litigation, class action, employment, IP, white collar defense, bankruptcy, public finance, commercial law, health care enforcement defense, and telecommunications in order to provide our clients with a holistic, effective strategy for tackling their most complex business challenges.

In addition to our work on appeals for new clients who may be looking for highly skilled appellate attorneys to complement existing trial counsel, our attorneys in this area also focus on retaining existing litigation clients through the appellate phase of a case, which may include acting as “embedded appellate counsel” within existing trial teams in order to ensure the preservation of issues for an eventual appeal. Recently, the Mintz team assisted a client with an investigation into a major breach at a fourth-party service provider that impacted the client’s business, avoiding regulatory action against the client and obtaining full indemnification from the client’s service provider for all costs and expenses incurred in connection with the breach. The team is also deeply involved with advising clients on establishing compliance programs for the new and evolving US privacy landscape, which includes laws in California, Connecticut, Colorado, Virginia, and Utah.
