Practice Overview
In the Appellate Practice Group, our capabilities include appeals at both the state and federal levels, as well as amicus curiae submissions to the United States Supreme Court. We continuously collaborate across practice areas, including securities and shareholder litigation, class action, employment, IP, white collar defense, bankruptcy, public finance, commercial law, health care enforcement defense, and telecommunications in order to provide our clients with a holistic, effective strategy for tackling their most complex business challenges.
In addition to our work on appeals for new clients who may be looking for highly skilled appellate attorneys to complement existing trial counsel, our attorneys in this area also focus on retaining existing litigation clients through the appellate phase of a case, which may include acting as “embedded appellate counsel” within existing trial teams in order to ensure the preservation of issues for an eventual appeal. This model ensures a streamlined and cost-effective approach to appellate representation for our clients, significantly reducing the amount of time it takes for our appellate team to get up to speed.

Mintz’s Investment Funds Practice regularly counsels and represents investment advisers across the full spectrum of private investment funds — including venture capital funds, buyout funds, real estate funds, credit and debt funds, infrastructure funds, funds of funds — and other bespoke closed-end investment fund products, hedge funds, and business development companies, as well as broker-dealers, trustees, and managers in all aspects of their activities.
We assist sponsor clients with services such as product development, fund organization and formation, internal infrastructure and restructurings, and funding and advising on mergers and acquisitions, as well as with the establishment and maintenance of appropriate operating procedures, including the securities, tax, and ERISA work involved at each of those stages. Client Experience
Recently, the Mintz team assisted a client with an investigation into a major breach at a fourth-party service provider that impacted the client’s business, avoiding regulatory action against the client and obtaining full indemnification from the client’s service provider for all costs and expenses incurred in connection with the breach. The team is also deeply involved with advising clients on establishing compliance programs for the new and evolving US privacy landscape, which includes laws in California, Connecticut, Colorado, Virginia, and Utah.

Mintz’s Privacy & Cybersecurity Practice, founded by Cynthia Larose, is a multidisciplinary group of more than 20 attorneys, a number of whom have certifications (CIPP/US and CIPP/E) issued by the International Association of Privacy Professionals recognizing facility with and knowledge of privacy and security processes and procedures. Our practitioners have broad experience related to technology, communications, health, antitrust, employment, and consumer protection. We regularly advise clients in relation to issues and risks presented by privacy and cybersecurity in corporate transactions, international business operations, and public policy development, as well as conduct privacy audits, gap analyses, and risk assessments. In the event of an incident, the team helps companies respond, and manage the investigation, mitigation, and resolution of any privacy and security breaches.

Mintz assists clients with permitting, acquisition/land assembly, ground leases, bridge, development and permanent financing, programmatic and specific joint venture transactions, environmental remediation strategies, design and construction contracts, disposition strategies, leasing, and condominium creation, all related to project development.
