The Court of Appeals for the Fourth Circuit will hear an appeal of a West Virginia federal court’s certification of a class in a TCPA case without consideration of the defendant’s Established Business Relationships with the named plaintiffs.

In Davis v. Coast Dental, a federal district court in Florida held that receipt of an unsolicited marketing call is not enough, standing alone, to state a Florida Telephone Solicitation Act claim.
